Not Grand’s Privacy Law: Fundamental Questions for Comprehensive U.S. Regime

The United States Congress may well enact privacy legislation that will be unlike the sector-specific legislation the nation has seen in the past or the Federal Trade Commission’s current deception and unfairness authority. It also will not be a GDPR clone. Instead, it will be comprehensive privacy legislation with some prior processes and subsequent enforcement, guidance on use beyond the public common understanding, and resources to initiate investigations. To legislate, consensus needs to be reached on some basic infrastructure issues including the difference between oversight and enforcement, fairness requirements rather than unfairness prohibitions, and resources necessary for trust and confidence.
