This panel will discuss how privacy and civil liberties officers help ensure that their large organizations handling intelligence and law enforcement design their programs to protect privacy and promote transparency. The U.S. Departments of Justice (DOJ) and Homeland Security (DHS) and the Office of the Director of National Intelligence (ODNI) oversee large federal law enforcement and national security agencies containing numerous components, some of which are larger than existing cabinet agencies. Their chief privacy officers must provide both advice and oversight to ensure that law enforcement and intelligence activities keep the public both safe and free. Not only must they apply their knowledge of what is legally required, they must also bring to bear relevant policy and ethical considerations. This panel will examine the tools and techniques they use to carry out their responsibilities and will discuss the range of challenges they face. Panelists will consider many of the questions that a privacy office faces in any large organization, such as: How do privacy officers gain leadership buy-in and a seat at the table during policy and program development? How do they balance their advisory functions with their substantial compliance and oversight responsibilities? What are the key relationships to nurture and develop? How should agencies interact with external oversight entities? How do they ensure that programs being conducted within large agencies receive meaningful privacy review? How do oversight officials at headquarters establish and maintain productive relationships with operational components? How can agencies provide transparency while also protecting highly sensitive information (law enforcement and national security information)?
