As it is getting clearer　that　law enforcement　has the limitation as the countermeasure against　cyber crime　and/or　cyber espionage, the more people are talking about the Active Cyber Defense（ACD） as the countermeasure. However, the concepts and legality of actual measures are still ambiguous. This presentation tries to clarify the legal issues of each ACD technique such as “hack back”，unauthorized access for security research, beacon, take down of botnet and sinkhole from Japanese law perspective．Additionally, NICT(National Institute of Information and Communications Technology) law amendment in Japan will be explained in this presentation.
